Terms and Conditions
Welcome to Qazaqstan Tourism Kairatbek (“Company”, “we”, “our”, “us”).
By accessing or using our website, products, and services (collectively, the “Services”), including, but not limited to, guided tours, you agree to comply with and be bound by these Terms and Conditions. These terms apply to all aspects of our business, both online and offline.
If you do not agree, please do not use our Services.
Please pay careful attention to the clauses about passport requirements, age and health restrictions.

General Use of Services
You must be at least 18 years old or have parental/guardian consent to use our Services. If participants are minors (under 18), they must be accompanied by an adult.
You agree to use our Services only for lawful purposes and in compliance with all applicable laws.
Participation in our tours is voluntary, and you acknowledge the inherent risks involved, including but not limited to accidents, injuries, theft, adverse weather conditions, and transportation delays.
We reserve the right to refuse service to anyone for any reason, including but not limited to disruptive behavior, intoxication, or failure to comply with safety instructions.
Passport, Visa and Travel Documents
It is the participant’s responsibility to possess valid travel documents.
Participants must secure any required visas or permits.
Participants should check entry/exit requirements with embassies.
We are not responsible for issues arising from missing, invalid or incorrect documents.
All related costs are the participant’s responsibility.
Bookings, Payments, and Fees
All tour prices are listed in CHF and are subject to change without notice.
To secure a booking, a non-refundable deposit or full payment of 500 CHF must be made at the time of reservation.
If payment is not received by the due date, your booking may be canceled without notice.
Additional fees may apply for last-minute bookings, changes, or special requests.
We accept no liability for incorrect payment details provided by the customer. In the event that the payment fails due to incorrect payment details provided by the customer, or if a technical issue occurs preventing the completion of payment, it is the customer’s responsibility to promptly correct the details or provide an alternative payment method. If the payment issue is not resolved within 5 business days of the booking, your reservation may be automatically canceled, and no refund will be provided. We are not responsible for any issues arising from the customer’s payment provider, including but not limited to, transaction errors, insufficient funds, or payment system failures. Customers will be notified of any failed transactions and must take action to rectify the issue promptly.

Validity
All dates, itineraries, and prices are valid from 01 January 2024 until 31 December 2025. Any information beyond 31 December 2025 is indicative only and subject to change without prior notice.
Booked services are valid only for the specific dates indicated in the invoice or booking confirmation. Any changes to the dates may be subject to availability, additional fees, or cancellation policies as outlined in these Terms and Conditions.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities, and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
If we make a major change, we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made, you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only, or accepting an alternative tour offered.
We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations, or non-refundable flights.
Deposit Requirement
At the time of booking, a non-refundable deposit of CHF 500, as applicable, per person per trip, is required for your booking to be confirmed.
If your booking is made within 15 days of the departure date, the full amount is payable at the time of booking.
Please note that a higher deposit may be required for certain selected trips, which will be communicated at the time of booking.
Acceptance of Booking and Final Payments
If we accept your booking, we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 7 days of departure the contract will exist when we accept your deposit.
Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 15 days before the departure date. Please note that full payment may be required earlier for some selected trips. If this balance is not paid on or before the due date, we reserve the right to treat your booking as canceled by you.
Your Details
In order for us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry date, and any pre-existing medical conditions that may affect your ability to complete your travel arrangements. Your booking cannot be confirmed without the provision of these details.
Inclusions
The land price of your trip includes:
  • All accommodations as listed on the website
  • All transport listed on the website
  • Sightseeing and meals as listed on the website
  • The services of a group leader as described on the website
Exclusions
The land price of your trip does not cover the following:
  • International or domestic flights unless explicitly mentioned in the itinerary
  • Airport transfers, taxes, and excess baggage fees unless specifically included
  • Meals outside those listed in the itinerary
  • Visa and passport fees
  • Travel insurance
  • Optional excursions, activities, and any personal expenditures
Prices & Surcharges
Our trip prices are subject to variable and seasonal pricing, both of which are standard practices within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions, and availability. It is likely that different passengers on the same trip may have been charged different prices. Your best option if you like the price you see is to book at that time. Once you have received a quote, the price will be locked in provided you pay the required deposit prior to the quote’s expiry.
Any reduced pricing or discounts that may become available after you have paid your deposit will not apply.
If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply.

Cancellations, Refunds, and Rescheduling
Cancellations made 15 days or more prior to the scheduled tour date are eligible for a refund, subject to a deduction of the non-refundable deposit.
Cancellations made within 15 days of the scheduled tour date are non-refundable.
No refunds will be issued for participants who fail to attend the tour, including no-shows or those who arrive late. Late arrivals are subject to the discretion of the tour guide. If the participant misses the scheduled departure, the tour will proceed without them, and they forfeit their payment. However, we may make reasonable efforts to accommodate late arrivals by attempting to meet up with the group at a later location, time permitting and at the sole discretion of the tour guide.
If a participant voluntarily leaves a tour or is removed due to behavior, health, or safety concerns after the tour has commenced, the Company is under no obligation to provide any refund for unused services, accommodations, or activities.
Tours may be rescheduled at our discretion, subject to availability.
We reserve the right to cancel a tour due to weather conditions, safety concerns, low participation, or unforeseen circumstances. In such cases, customers may receive a full refund or reschedule for a later date.
In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be less than any unrecoverable costs.
If the minimum group size is not met, the Company reserves the right to cancel the trip up to 30 days before the scheduled start date. In such cases, we will make every effort to offer you an alternative trip or, if you prefer, provide a surcharge option to operate the tour with fewer participants. If neither option is acceptable, you are entitled to a full refund of the tour price previously paid. No additional claims will be accepted.
We are not responsible for reimbursement of personal expenses incurred due to tour cancellation, including but not limited to flight tickets, accommodation, travel insurance, visa fees, transportation costs, or any other related expenses.
Participant Responsibilities and Conduct
Participants must arrive at the designated meeting point on time. Late arrivals may result in forfeiture of the tour without refund.
Participants are required to truthfully disclose any medical conditions, allergies, or physical limitations at the time of booking to ensure their own safety and the safety of the group. See Section 9 for health eligibility and participation requirements.
Participants must wear appropriate clothing and footwear suitable for the activity and weather conditions.
Participants are responsible for securing their personal belongings. The Company is not liable for lost, stolen, or damaged items.
Any participant engaging in reckless behavior, illegal activity, or actions that endanger themselves or others may be removed from the tour without refund. We may also elect not to carry you on any future trips booked.
You must at all times comply with the laws, customs, foreign exchange, and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
You acknowledge that the trip is adventurous and involves personal risk, with dangers and physical challenges beyond daily life. While we assess risks based on government and other reports, it is your responsibility to gather all relevant travel information and accept the inherent risks involved.
Age, Health, Safety, and Insurance
Participants acknowledge and accept all inherent risks associated with the tour, including but not limited to physical injuries, illness, dehydration, and exposure to extreme weather conditions.
Age Requirements:
  • Culture Tours: Minimum age 6
  • Hiking Tours: Minimum age 12
  • Adventure, Trekking, and Grand Tours: Minimum age 18
  • There is no upper age limit; however, participants must ensure they are in suitable physical condition for the tour.
Health Requirements and Participation Criteria:
The following medical conditions will not be accepted for participation due to safety concerns:
  • Severe cardiovascular conditions (e.g., heart disease, recent heart attack, or stroke)
  • Uncontrolled epilepsy or seizures
  • Severe respiratory conditions (e.g., advanced asthma or COPD)
  • Severe allergies that may lead to anaphylaxis, unless the participant carries appropriate emergency medication and is capable of self-administration
Any other condition that, in the opinion of a licensed healthcare provider, may pose a safety risk during the tour
A doctor’s note may be required for certain other conditions. The Company reserves the right to refuse participation if a health condition is deemed a safety risk.
All travelers under the age of 18 must be accompanied by a legal guardian or an appointed escort over 18. The accompanying adult is fully responsible for the minor during the tour.
Triple or adjoining rooms cannot be guaranteed.
Participants must follow all safety instructions provided by the guide or staff. Failure to comply may result in removal from the tour without refund.
The Company reserves the right to refuse participation to any individual due to health concerns, intoxication, or behavior that compromises safety.
Travel Insurance
All our clients need to have personal travel insurance. You are responsible for obtaining the insurance. Your travel insurance should provide cover against personal accident, death, medical expenses, and emergency repatriation, with a recommended minimum coverage of CHF 200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability, loss of luggage, and personal effects.
Travel insurance information will be gathered by the tour leader on the first day of your trip.
We recommend that you read carefully the General Terms and Conditions of your Insurance before Departure.
Liability and Limitation of Liability
Participants agree to indemnify the Company from claims except in cases of gross negligence or willful misconduct.
We are not liable for participant or third-party negligence. We do not accept liability for the failure of any transportation services, accommodation, or other facilities beyond our control. We are not responsible for delays from external providers or events.
We are not liable for any loss or damage arising from factors such as but not limited to: negligence of the participants, war, strikes, acts of terrorism, natural disasters, weather, political instability, or other circumstances beyond our control. Therefore, we are not liable for changes in an itinerary caused by strikes, social unrest, weather conditions, decisions taken by the authorities, third-party delays, etc., or for changes in schedule due to flight schedule changes.
Our liability in respect of any claims arising from the provision of the Services, excluding personal injury, willful or gross negligence, is limited to twice the total cost of the booking and does not include any additional indirect or consequential damages.
You acknowledge and accept that participation in the tour, including activities such as hiking, trekking, or other physical activities, involves inherent risks. We shall not be liable for any injury unless it arises from the non-performance or improper performance of our contractual obligations. Nothing in this clause shall limit or exclude our liability where such limitation or exclusion is prohibited by law.
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.
If you have a complaint about your trip, please inform your group leader or our local representative at the time in order that they can attempt to rectify the matter.
The claim or complaint must be submitted to the company in writing no later than 4 weeks after the end of the trip; otherwise it will be forfeited. All compensation claims are time-barred 1 year after the end of the trip.
Force Majeure
We shall not be liable for any failure to perform or delay in performance of any of our obligations under these Terms and Conditions if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, strikes, lockouts, civil unrest, terrorism, disasters, pandemics, or governmental actions.
If we are affected by force majeure, we will promptly inform you of the delay or failure in performance and may, at our discretion, either extend the period for performance or provide you with an alternative arrangement.
Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland.
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, including the existence, validity, interpretation, performance, breach, or termination thereof, shall first be resolved through meditation and, if unsolved, by binding arbitration in accordance with the Swiss Arbitration Rules.
In the event of a legal dispute, the parties agree to resolve the matter through arbitration rather than through litigation, unless otherwise specified by applicable law.
We are not responsible for participant legal fees.
Photography and Media Release
We may photograph or film tours for promotional and archival purposes.
By participating in our tours, you consent to the use of your image, likeness, or voice in photographs, video, or other media for marketing and promotional purposes, without compensation.
If you do not wish to be photographed or recorded, please inform your guide at the start of the tour.
Privacy Policy and Data Protection
By using our Services, you consent to the collection, use, and processing of your personal information as described in our Privacy Policy.
We take your privacy seriously and comply with applicable data protection laws to ensure that your personal information remains secure. Your personal data may be used for communication, booking management, marketing (where permitted by law), and service improvement. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate.
You have the right to request access, correction, or deletion of your personal data in accordance with applicable laws.
User Accounts
You are responsible for your account credentials.
We may suspend/terminate accounts for misuse.
We protect account information with reasonable measures.
All Rights Reserved
Website content is our property.
Use is restricted to personal, non-commercial purposes.
Unauthorized use is prohibited.
Legal action may follow IP violations.
Third-Party Services and Links
We may link to third-party sites.
We are not responsible for third-party content.
Interactions with third parties are at your own risk.
Amendments to the Terms and Conditions
We reserve the right to amend or update these Terms and Conditions at any time. Any changes will be published on our website, and your continued use of our Services after such publication constitutes acceptance of the revised Terms and Conditions
It is your responsibility to review the Terms and Conditions periodically to stay informed of any updates. The latest Terms and Conditions can always be found on the Company website and supersede any previous versions.
No Waiver
Our failure or delay in enforcing any provision of these Terms and Conditions shall not constitute a waiver of such provision or our right to enforce it later.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Assignment
We may assign or transfer any of our rights and obligations under these Terms and Conditions to a third party without prior notice.
You may not assign or transfer your booking or rights under this agreement to any other person without our prior written consent.
Acknowledgment and Agreement
By booking or participating in a tour, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
If you are making a booking on behalf of others, you confirm that you have obtained their consent to accept these Terms and Conditions on their behalf.
